SP Balrampur filed an affidavit in the High Court Lucknow bench and informed about the notice of polygraph test. But hid the fact that the Balrampur court had already rejected the police’s application for conducting a polygraph test.
Lucknow: A hearing was held in the High Court regarding the polygraph test in the rape case of a 14 year old girl in Balrampur district. Meanwhile, the High Court has ordered the Principal Secretary Home to respond to the matter or else appear in the court. The High Court has expressed surprise over the false affidavit of SP Balrampur. Balrampur police sent a notice to the minor victim and her father, who had filed the FIR in a case of kidnapping and rape, to undergo a polygraph test.
Order to reply to Chief Secretary
SP Balrampur filed an affidavit in the High Court Lucknow bench and informed about the notice of polygraph test. But hid the fact that the Balrampur court had already rejected the police’s application for conducting a polygraph test. The High Court termed the affidavit of SP Balrampur as false and termed it as shocking. The High Court ordered the Principal Secretary Home to file a personal affidavit in this matter and respond to the entire matter. If this did not happen, the Principal Secretary Home was ordered to appear in the court on the next hearing.
Father demanded re-recording of daughter’s statement
The High Court double bench has given the order on the petition of the father of the minor victim. In the petition, a demand has been made to transfer the investigation of the FIR related to the incident to some other district. On the petition, SP Balrampur, while giving a counter affidavit, said that there is a difference in the statements given by the victim on 28 October 2024 and 19 March 2025. Therefore, notice has been given to the victim and her father to undergo polygraph test. Information was given on behalf of the petitioner that in relation to the FIR registered on October 22, 2024, an application was given in the local POCSO court on behalf of the victim. It was said in the application that the statement given by the victim on October 28, 2024 was given under the pressure of the accused and the police. Therefore, his statement should be recorded again.
The state government challenged the court’s decision in the High Court
On that application, the POCSO court ordered to record the statement again on January 8, 2025. In compliance with the order, repeated statements were also recorded on March 19. But the state government challenged the order of Balrampur Court of January 8 in the High Court. The High Court expressed surprise that the order could have been challenged by the accused. Why did the state government feel the need to file a petition?
SP lied in the affidavit
It was also brought to the notice of the court that the application of the police regarding polygraph test was rejected by the Balrampur court on December 1 itself. But the SP said in his affidavit that the application is under consideration. The High Court ordered the Principal Secretary Home to file a personal affidavit in the matter regarding filing of false affidavit and polygraph test of the minor and the father. The next hearing of the case will be on December 15.
