Himachal Illegal Encroachment: There is a big issue regarding illegal encroachments in Himachal Pradesh. After the High Court, the matter is also under consideration in the Supreme Court. Recently, the Sukhu government had said in the assembly that it would protect the interests of these people, but now the government’s dual attitude is visible and now notices have been issued to the illegal encroachers to remove their encroachment.

According to the information, the Revenue Department of the government issued notices on Thursday to the occupiers of government land, apart from forest land. An occupier in the market, on the condition of anonymity, said that a notice has been issued on December 2 and instructions have been given to remove the encroachment within 10 days. It is clearly written in the notice that if the government land is not vacated then the encroachment will be removed by the police and administration and then the owner will have to bear the cost of this. Notice has also been issued to people encroaching on forest land in Rohru, Shimla.

In the winter session of Himachal Pradesh, Leader of Opposition Jai Ram Thakur had questioned the government on this matter and alleged that the government was not serious about the issue of 1.25 thousand people. However, Revenue Minister Jagat Singh Negi had said in the House that our government is fighting for the rights of 1 lakh 24 thousand 780 people in the Supreme Court. CM Sukhu had also assured the House that the fight for the interests of the people would be fought strongly and the interests of not 1 lakh 24 thousand but 1 lakh 60 thousand people would be protected. Jagat Singh Negi had even said that even if Section 163 of the Land Revenue Act is re-recognized by the Supreme Court, it will not be beneficial because the government does not have the land. All the waste land is forest land, only if the central government amends the FCA, people will get relief.

High Court repealed the law
It is noteworthy that on August 5, Himachal High Court had canceled this 23 year old policy. The High Court has issued orders to remove illegal encroachments from government land by 28 February 2026. However, the matter is now in the Supreme Court and the court has given orders to maintain the status quo. Under the policy of regularization of illegal encroachments, the BJP government had sought applications from people encroaching on government land and during this period, one lakh sixty-five thousand people had applied for regularization of illegal encroachments. Later in 2002, the BJP government amended the Land Revenue Act and added Section 163-A, but it was rejected by the High Court. Under this section, a provision was made to give land ranging from five to 20 bighas to people and to regularize it.
