Some special rights have been given to the MLAs and MPs of the Assembly and Parliament. No case can be prosecuted on the words spoken by an MLA or MP in the Assembly. If any MLA is stopped or threatened while coming to the Assembly, or if the MLA’s words are distorted and presented with a wrong purpose, then it is considered a breach of privilege. The MLA complains about this to the Speaker and then the Speaker decides whether the matter is serious or not. Later, if the matter becomes serious, it is also sent to the Privileges Committee. During this, the accused is warned or a censure motion is brought. The guilty person can be called to the House and reprimanded publicly. If the case is very serious, the accused can be kept in custody for the whole day or for some time.
On the other hand, government officials can also be suspended. Earlier, Baddi’s Doon MLA Ram Kumar Choudhary had also given a notice of breach of privilege against the then SP Ilma Ifroz.
