Judge G Narendra can pronounce the verdict in this matter on Friday. The judge wanted to know whether the American company Twitter can be called the parent company, Maheshwari’s counsel CV Nagesh said, “Twitter Inc is the parent company. We really have nothing to do with it (Twitter Inc.).” The lawyer said, “Twitter India is an independent organization and an independent institution. When the judge asked about the promoters and shareholding of Twitter India, Nagesh said that Twitter India is only associated with Twitter Inc.

To this the judge said that there is no such thing as a linked company. Generally, under the terms of shareholding and constitution of the company, it is called a subsidiary or an associated company. The lawyer then said, “…Actually Twitter USA (Inc) does not have a single share in Twitter India. That’s why I said that it is a completely different company.” Advocate P Prasanna Kumar, appearing for Ghaziabad Police, said that Twitter Inc will have to face the consequences of the statement that they do not know who Twitter India is.

Kumar said, “From the information available with me, 99 per cent shares of the company are held by Twitter Inc.” During the arguments, Nagesh urged for permission to produce records on Friday which would show that Twitter USA is not a shareholder. Describing the shareholding pattern, he said that Twitter International Company has its headquarters in Ireland. It has 9,999 shares while Twitter Netherlands has one share. However, Twitter Inc. is responsible for the operation of the platform.
It is noteworthy that on June 21, Ghaziabad (Uttar Pradesh) police had issued a notice under Section 41-A of the Criminal Procedure Code (CrPC) asking Maheshwari to report at Loni Border Police Station on June 24 at 10:30 am. He then moved the Karnataka High Court as he lives in Bengaluru, Karnataka. The High Court in an interim order on June 24 restrained the Ghaziabad Police from taking any coercive action against Maheshwari. Judge Narendra also said that if the police want to inquire, they can do it online.
