New Delhi: The Supreme Court on Monday rejected that petition of BJP leader Shahnawaz Hussain. The petition challenged the High Court’s order to register an FIR on the complaint of a woman who had alleged rape. Former Union Minister Hussain’s advocate Justice S. A bench of Justice Ravindra Bhat and Justice Dipankar Dutta said, ‘First let there be a fair investigation in this matter, if there is nothing, you will be absolved.’ Senior advocates Mukul Rohatgi and Siddharth Luthra, appearing for Hussain, told the bench that the complaint against the leader has been lodged on the complaint of the woman complainant.
Rohatgi said in his plea, ‘A complaint has been lodged on the complaint, which was investigated by the police, but nothing was found. This cannot continue indefinitely. Rohatgi said it was a “series of relentless attacks” against Hussain. However, the bench said, “We do not find any reason to interfere.” The high court had on August 17 last year dismissed Hussain’s plea challenging the lower court order, saying there was nothing wrong with the 2018 order. The lower court had ordered the Delhi Police to register an FIR against him.

On August 22, 2022, the apex court had stayed the implementation of the High Court order. During its earlier hearing before the Supreme Court, Hussain’s counsel had argued that the complaint was ‘false’ and ‘malicious’. In the year 2018, a woman from Delhi had approached a court here, requesting registration of an FIR against Hussain for alleged rape. However, the Bharatiya Janata Party (BJP) leader has denied these allegations.
On July 7, 2018, the magistrate court had ordered registration of an FIR against Hussain. The court had said that a case of cognizable offense has been made out against Hussain in the complaint. This order was challenged by the BJP leader in a sessions court, but his plea was dismissed. In this case, on Hussain’s appeal, the High Court said in its order, ‘There is no merit in the present petition. The petition is dismissed. The interim order staying the proceedings against Hussain is vacated. FIR should be registered without delay.
