New Delhi: Hearing on the bail of accused Ashish Mishra in the Lakhimpur Kheri Case of UP was held in the Supreme Court today i.e. on Thursday. During this, the UP government opposed the bail of Ashish Mishra, while Dushyant Dave, the lawyer for the aggrieved party, also advocated not to grant bail to the accused in the case. However, the Supreme Court became strict on this matter and said that if the court does not consider the bail of the accused, then who will? On the matter of Dushyant Dave, the Supreme Court said that should we remain mute spectators?
In fact, during the hearing, when Dushyant Dave, the lawyer for the aggrieved side, said that the Supreme Court should not grant bail to the accused in the heinous crime case, then the Supreme Court said that should we remain mute spectators. It is within our power to hear and decide the demand for bail under law. Take care of the scope. After this Dushyant Dave said that this is a very serious matter. The accused and his minister father have threatened and intimidated the victims.
‘Jail is the exception, granting bail is the rule, strict conditions for bail… equivalent to not granting it’, know why SC said this
In response to this, the Supreme Court said that the father of the accused is a minister, but not the accused in this case. Dushyant Dave said that the minister’s father should also be made an accused. The Supreme Court said that if the court will not consider the bail of the accused, then who will? They also have the right to keep their words. Let us tell you that earlier in the beginning of the hearing, the UP government said that the trial has started in this case and some more accused are in jail in this case.
Advocate Mukul Rohatgi, who appeared in the court on behalf of Ashish Mishra, said that Ashish Mishra has been in jail for the last one year. Once he got bail, then the Supreme Court rejected the bail. There are more than 400 witnesses in this case, whose statement is to be made. In this case the trial will run for 5 years and what will happen to my client in this case? Ashish Mishra’s lawyer said that in the second FIR that has been registered, the allegations have been exaggerated. No eyewitness has come forward in this case. It was told on behalf of the UP government that the bail of the 4 accused in this case has been opposed in the trial court. The lawyer of the UP government said that Ashish Mishra should not be given bail, we are opposing his bail.
After this, the Supreme Court asked the UP government in this matter that when the charge sheet has been filed, the charge frame has been made, then in such a situation, debate the aspect of bail. The Supreme Court asked that in this case, tell something new about the opposition to bail. In the Supreme Court, the UP government said that Ashish Mishra should not be given bail in this case. Lakhimpur incident was very painful and it is a serious matter. If Ashish Mishra is granted bail, it will send a wrong message to the society. At the same time, Dushyant Dave said that if the accused Ashish Mishra gets bail, then I say from my 44 years of experience that the trial in the lower court will not be able to go in the right direction.
