Prayagraj. Allahabad High Court has made an important comment while hearing the bail application of an accused in Bareilly violence. The court said that the slogan raised by any person or crowd “Gustak-e-Nabi ki ek hi saza, sar tan se juda, sar tan se juda” is a challenge to the right of law as well as to the sovereignty and integrity of India, as it incites people to armed rebellion. Therefore, this will not only be punishable under Section 152 of the BNS but is also against the basic principles of Islam. High Court With the comment, the bail application of Rehan, an associate of Maulana Tauqeer Raza in the violence in Bareilly in September, was rejected. The single bench of Justice Arun Kumar Singh Deshwal rejected the bail application. State government’s Additional Advocate General Anoop Trivedi opposed the bail application.

A case is registered against accused Rehan under various sections in Bareilly Kotwali police station. It was said in the bail application that he has been wrongly implicated. According to the prosecution, Ittefaq Minnat Council President Maulana Tauqeer Raza and Nadeem Khan had called upon the Muslim community to gather in the grounds of Islamia Inter College and protest against the state. Despite the ban on illegal gathering contrary to Section 163 of BNS, people gathered here after Namaz on 26 September 2025 protested. A crowd came out of Nadeem Khan’s house and raised slogans against the government, including “Gustak-e-Nabi ki ek sajja, sar tan se juda”. The police tried to stop them, but they broke the lines of policemen, tore their uniforms, and resorted to petrol bombs, firing and stone pelting, injuring several policemen and damaging several police and private vehicles.

Even in Hinduism, slogans like “Jai Shri Ram” or “Har Har Mahadev” are used on occasions of happiness and joy. The use of these slogans is not a crime as long as they are not used to intimidate or threaten people of other religions. Although the slogan “Gustak-e-Nabi ki ek saja, sar tan se juda” is not found in the Quran or other Muslim religious texts, yet many Muslims use it without knowing its true meaning and impact.
