Vijay Mallya News: Vijay Mallya has filed a petition in the Karnataka High Court. The petition demands details of seized properties and loans. The next hearing of the case will be on November 12.
New Delhi. Fugitive liquor baron Vijay Mallya on Tuesday filed a petition in the Karnataka High Court seeking details of seized properties and outstanding loans. Also, the petition has appealed to the High Court to direct a group of banks to stop charging interest on those loans, the amount of which has already been recovered. Mallya claims that the banks have recovered more money from him and his defunct Kingfisher Airlines than the original outstanding amount.
Advocate Sajan Poovayya, appearing on behalf of Mallya, told the court that the recovery so far has exceeded the loan amount. He cited a press release from the Enforcement Directorate (ED), which said ₹7,181 crore had been recovered, while the Finance Ministry reported that assets worth about ₹14,000 crore had been handed back to banks.
Banks protested
Advocate Vikrant Hulgol, appearing on behalf of the banks, opposed this petition. He said that Mallya is absconding from Indian courts, hence he cannot seek any relief under Article 226 of the Constitution. He also said that the recovery made under the Prevention of Money Laundering Act (PMLA) is provisional and has not been finally decided.
During the hearing of the writ petition, Justice Lalita Kanneganti asked Mallya’s lawyer, why did you not file the petition in the company court? How can you ask for such financial details from banks through a writ petition? On this, Mallya’s lawyer said that it is Mallya’s constitutional right to file a writ petition before the High Court.
