The organization claimed that Muslims and Christians in Kerala have made enormous progress in the field of socio-economic and education and hence their minority status needs to be re-determined and no special priority should be given to them. It has also urged the commission to be directed to evaluate the progress of development of both the communities in the state.
Center should respond to petitions related to grant of minority status: Supreme Court
By issuing notices to the Ministry of Home Affairs, the Ministry of Law and Justice and the Ministry of Minority Affairs in February 2021, the Supreme Court against the notification for grant of minority status. The petitions pending in various High Courts have been urged to be transferred to the Apex Court, where they are not a minority.
A bench of Chief Justice SA Bobde, Justice AS Bopanna and Justice V Ramasubramaniam issued notices to the Ministry of Home Affairs, Ministry of Law and Justice and Ministry of Minority Affairs. Significantly, petitions challenging the constitutional validity of provision 2(c) of the National Commission for Minorities Act, 1992 are pending in the Delhi, Meghalaya and Guwahati High Courts. Under this law, the government issued a notification on October 23, 1993, declaring Muslim, Christian, Sikh, Buddhist and Parsi communities as minorities across the country. The petition alleged that the situation has become such that in Punjab, where the majority of the population is of Sikhs, in Jammu and Kashmir, the majority of the Muslim population is getting the benefits of minorities.
