New Delhi. The anticipatory bail plea of Luthra Brothers (Saurav and Gaurav Luthra) related to the Goa Club fire incident has been rejected in Delhi’s Rohini Court. The Goa Police, which was engaged in bringing them back home from Thailand, is now free to take any strict action against the Luthra brothers. In the copy of the order, Rohini Court recorded serious grounds in rejecting the anticipatory bail plea of Luthra Brothers. The court said that the allegations are very serious because 25 people lost their lives in this accident. The court also raised questions on the behavior of the two brothers. It was said that booking a ticket on the same day of the fire incident and leaving Goa overnight is suspicious. The court also recorded that the petitioners hid many facts, hence it is not appropriate to grant them relief.
Strong side of Goa Police
Earlier, Goa State Counsel strongly opposed the bail in the court. The arguments of the prosecution were so strong that everyone in the court was shocked. Goa Police made serious allegations against the Luthra brothers. It was said that when his night club in Goa was burning, he was booking tickets to Thailand. During the hearing, a big revelation was also made on the status of the license. The prosecution told the court that the trade license on which the Luthra brothers are relying was issued by the panchayat. This license had already expired in 2023. It has not even been renewed yet.
We are ready to come to India immediately: Luthra Brothers
Advocate Tanveer Ahmed Mir, appearing for Luthra Brothers in Rohini Court, stressed in the court that no matter what happens today, I am bringing my clients back… They will return to India today itself.” Mir also appealed to the court to take his statement on record because he himself had advised his clients to return and cooperate in the investigation under any circumstances. The defense side said that Blue Corner Notice is issued only for giving information and not for detaining, but now the process of cancellation of passport and deportation has started. He asked for limited transit Antrim bail of only 2–4 days so that the accused could appear directly before the agency. The defense also cited serious health problems.
Booked ticket to Thailand after fire in night club
Goa Counsel further said that the Luthra Brothers’ own lease documents refute their arguments. It is clearly written in the documents that this establishment was run by Luthra Brothers only. Therefore they cannot run away from responsibility. He has also not cooperated in the investigation. The arguments of Goa Police on the matter of fleeing to Thailand were the most shocking. The counsel told the court that he booked tickets to Thailand immediately after receiving the news of the fire. According to the police, on December 7, at 1:15 am, he booked the ticket through ‘Make My Trip’. Then the same morning he went to Thailand by Indigo flight. The police clarified that he had no business dealings in Thailand. This was an attempt to escape.
Lookout notice and Interpol action
Goa’s lawyer raised this question in the court that the escape of Luthra Brothers was confirmed when the police went to their house on 7 December. The mother and sister of the accused told that they do not know their location. His lawyer had also reiterated the same thing. Disappearing immediately after the incident, what does your conduct indicate? On the basis of this conduct the court issued non-bailable warrants. A lookout notice was issued against him on 7 December. After this, on December 9, Interpol issued a Blue Corner Notice. The Goa lawyer also told that Indigo Airlines has provided him the details of Saurav and Gaurav Luthra.
Goa’s night club continues to run without NOC
The fire department report made the matter more serious. The department said that NOC (No Objection Certificate) was not taken for the bar. Safety rules were grossly ignored. The biggest negligence was that there was only one way in and out of the bar. Due to this reason 25 people have lost their lives. Luthra Brothers were also accused of keeping wrong information before the court. Even correct information about his medical history was not given. Goa Police called it a complete “bogus case”. Goa Police stressed that you can go on a sudden trip abroad, but cannot come to cooperate in the investigation.
