Munger. The court’s decision in the much-discussed AK-47 case, which once gave sleepless nights to security agencies from Munger to Delhi, has now been shocking. After a seven-year long trial, the court acquitted all the ten accused in the AK-47 weapon parts recovery case that came to light in 2018 due to lack of evidence. This is the same case in which parts of AK-47 rifle were claimed to have been recovered. In this case, the lower court acquitted all the ten accused on the basis of weak testimony of the prosecution and lack of solid evidence. The court admitted that neither the place of incident could be proved properly nor any solid witness was presented in support of the allegations.

Long hearing, but evidence weak
During the hearing of the case, Additional Public Prosecutor Vinod Yadav presented arguments on behalf of the prosecution and advocate Vishwajit Singh presented arguments on behalf of the defense. At the same time, the accused side’s lawyer Vijay Jha argued in the court that the prosecution could neither prove the spot of the incident nor could legally strengthen the recovery process. The testimony of government witnesses also proved to be weak. After a long debate, the court came to the conclusion that the evidence presented was not sufficient to frame charges. On these grounds, giving the benefit of doubt, the court acquitted all the accused.
Who were released by court order?
Let us tell you that in this case Mohd. Rizwan Pathan, Mohd. Lukman, Aisha Begum, Tanveer Alam alias Sonu, Mohd. Gulfam alias Gulan, Mohd. Varijwan alias Bhutto, Mohd. Parvez Chand, Mohd. Mustaqeem, Mohd. Khurshid Alam and Mohd. Imran Alam’s wife Sada Rifat was made an accused. Of these, Tanveer Alam alias Sonu, Mohd. Gulfam alias Gulan and Mohd. Rizwan alias Bhutto was in jail under judicial custody, while the remaining seven accused were out on bail. Everyone was released after the court order.
FIR was registered on 30 September 2018
Let us also tell you that this case was registered in Mofussil police station on 30 September 2018. The case was registered on the basis of the written statement of the then Circle Inspector Bindeshwari Yadav. At that time, the police station incharge of Mufassil police station was Mintu Kumar Singh. It was stated in the application that Mohd. On the basis of the confession statement of Rizwan alias Bhutto, the land of Ajmeri Begum in Mirzapur Bardah village of Sadar block was excavated with JCB. This farm is Mohd. It was situated near the house of Ajmeri Begum, wife of Imran Alam. During the excavation, it was claimed that parts of AK-47 were recovered from a plastic sack kept buried in the ground.
Police will review the decision
The special thing is that the court has clearly said that the evidence presented was not sufficient to prove the allegations. Now after this decision of the court, once again questions are being raised on the strength of the police investigation and prosecution at that time. Munger SP Syed Imran Masood has said that the case will be reviewed and if any legal flaw is found then an appeal will be filed in the High Court.
Big lesson for investigating agencies
However, this decision in the AK-47 case is not just the release of 10 accused, but is also a warning. If investigation and prosecution in serious cases like arms smuggling remain weak, it will have a direct impact on the security of the country. Now there is a need for the investigating agencies to introspect, so that in future, justice in such sensitive cases does not remain limited to papers only.
