Allahabad High Court: Allahabad High Court made important comments during the hearing on the bail plea of an accused in Bareilly violence. The court said that the slogan “Gustak-e-Nabi ki ek hi saja, sar tan se juda, sar tan se juda” is a challenge to the sovereignty and integrity of India.
A case is registered against accused Rehan under various sections in Bareilly Kotwali police station. It was said in the bail application that he has been wrongly implicated. According to the prosecution, Ittefaq Minnat Council President Maulana Tauqeer Raza and Nadeem Khan had called upon the Muslim community to gather in the grounds of Islamia Inter College and protest against the state. Despite the ban on illegal gathering contrary to Section 163 of BNS, people gathered here after Namaz on 26 September 2025 protested. A crowd came out of Nadeem Khan’s house and raised slogans against the government, including “Gustak-e-Nabi ki ek sajja, sar tan se juda”. The police tried to stop them, but they broke the lines of policemen, tore their uniforms, and resorted to petrol bombs, firing and stone pelting, injuring several policemen and damaging several police and private vehicles.

Seven people were arrested from the spot, including the present accused. The court said, there is a matter of slogans and declarations in different religions. Generally people use it to express respect and reverence towards their religion. In the Muslim community “Nara-e-Takbeer” is followed by “Allahu Akbar”, which means God is the greatest and there is no dispute. Similarly, in Sikhism it is said “Jo Bole So Nihal, Sat Shri Akal”, this slogan was coined by Guru Gobind Singh. It accepts God as the ultimate truth. Even in Hinduism, slogans like “Jai Shri Ram” or “Har Har Mahadev” are used on occasions of happiness and joy. The use of these slogans is not a crime as long as they are not used to intimidate or threaten people of other religions. Although the slogan “Gustak-e-Nabi ki ek saja, sar tan se juda” is not found in the Quran or other Muslim religious texts, yet many Muslims use it without knowing its true meaning and impact.
