New Delhi: Notorious gangster Anmol Bishnoi will now remain in Tihar Jail, considered the most secure in Asia. Patiala House Court has sent him to judicial custody. But the biggest news is the order of the Home Ministry which has ‘locked’ Anmol in Tihar for a year. The government has used Section 303 of the Indian Civil Security Code (BNSS). This means that the police of any state cannot take custody of Anmol for the next one year. Be it Mumbai Police or Punjab Police, now the investigation will be done only inside Tihar. He will not be taken out of jail. This order is exactly the same as that applicable to his brother Lawrence Bishnoi.

The Home Ministry has issued this order citing security reasons. Anmol Bishnoi’s life is considered to be in danger. After intelligence input, the government does not want to take any risk. If the police of any state wants to interrogate Anmol then they will have to come to Delhi. The interrogation will have to be done within the boundary walls of Tihar Jail only. He will not be allowed to take it to any other state. This step has been taken in view of gang war and the possibility of attack on the way.

What is Section 303 of BNSS? understand in simple words

Section 303 of the Indian Civil Security Code (BNSS) 2023 gives a special power to the government. This section gives the central and state governments the right to stop the movement of any prisoner. If the government feels that there may be a danger if a criminal is taken out of jail, then this section is imposed. This includes fear of deterioration in law and order or deterioration of public order.
After this order the prisoner cannot be transferred out of the jail. The police cannot take him to another city or police station for questioning. He is not taken out even to appear in court. The production of such prisoners takes place through video conferencing. This rule is applied on dreaded gangsters and terrorists so that there is no lapse in security and jail remains their only destination.

Why was Anmol Bishnoi present in the court through video conferencing?

Anmol Bishnoi’s NIA remand was ending on Thursday. He was to be produced in Patiala House Court. But in view of the danger, he was not physically brought to the court. His appearance took place through video conferencing. After hearing the arguments, the court gave its decision to send him to judicial custody. Now his new destination is Tihar Jail. There he will be kept in a high security cell. The jail administration has made special arrangements for this.
