Neha had earlier filed a petition in the Supreme Court to cancel the FIR lodged at Hazratganj police station. The Supreme Court has already rejected Neha Rathore’s petition. The High Court accepted that despite the order, Neha was not cooperating in the investigation. The High Court said that despite the order of the double bench to appear before the investigator, the accused is not cooperating in the investigation. Neha Rathore’s special leave petition against that order of the double bench has also been rejected by the Supreme Court. It was argued on behalf of Neha that the comments made on social media are a matter of freedom of expression. On behalf of the government, government advocate Dr. VK Singh opposed the anticipatory bail petition. The government advocate argued that when the country was going through a sensitive situation, comments like “BJP wants to plunge the country into war and put the lives of thousands of soldiers at risk”. He was involved in the campaign to divert attention from Pakistan and prove the Prime Minister guilty.
